By clicking "Accept" or by using the CONFIRMD application ("the App"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use the App.
1. ACCEPTANCE OF TERMS
By creating an account and using CONFIRMD, you confirm that:
- You are at least 18 years of age
- You have the legal capacity to enter into binding contracts
- You have read, understood, and agree to be bound by these Terms and Conditions
- You agree to comply with all applicable laws and regulations
2. DESCRIPTION OF SERVICE
CONFIRMD provides:
- Automatic scanning and storage of MPESA SMS messages from your device
- Parsing of MPESA transaction details
- Organization of transactions into custom ledgers
- PDF report generation for your financial records
- Cloud synchronization across devices
3. SMS MESSAGE ACCESS AND PROCESSING
3.1 Permission Grant
By accepting these terms, you grant the App permission to:
- Read SMS messages from your device
- Filter and identify MPESA-related messages
- Store MPESA message content in our secure cloud database
- Parse transaction details from message content
3.2 Data Collection
The App collects:
- SMS message body (text content)
- Sender information (e.g., "MPESA")
- Message received timestamp
- Parsed transaction data (amount, sender name, transaction code, etc.)
3.3 No Third-Party Sharing
We will NOT:
- Share your SMS messages with third parties
- Sell your transaction data
- Use your data for marketing purposes
- Access non-MPESA messages
4. USER ACCOUNT AND SECURITY
4.1 Account Creation
You are responsible for:
- Providing accurate registration information
- Maintaining the confidentiality of your password
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
4.2 Account Security
You agree to:
- Use a strong, unique password
- Not share your account credentials
- Log out from shared devices
- Report any security breaches promptly
5. DATA STORAGE AND PRIVACY
5.1 Cloud Storage
Your data is stored using Supabase cloud infrastructure. By using the App, you consent to:
- Storage of your data on cloud servers
- Data processing as described in our Privacy Policy
- Reasonable data retention practices
5.2 Data Security
We implement industry-standard security measures including:
- Encrypted data transmission (HTTPS)
- Secure authentication
- Row-level security in the database
- Regular security audits
5.3 Data Access
Your data is accessible only to:
- You (via your authenticated account)
- Our technical staff (for support and maintenance)
- No other users or third parties
6. USER RESPONSIBILITIES
6.1 Lawful Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You will NOT:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Attempt to gain unauthorized access to our systems
- Reverse engineer or decompile the App
- Use the App for fraudulent activities
6.2 Accurate Information
You are responsible for:
- Verifying the accuracy of parsed transaction data
- Reporting any parsing errors or discrepancies
- Maintaining accurate ledger records
- Understanding that the App is a tool, not a financial advisor
7. DISCLAIMER OF WARRANTIES
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
We do not guarantee that:
- The App will be error-free or uninterrupted
- SMS parsing will be 100% accurate
- All transaction details will be correctly extracted
- The service will meet your specific requirements
The App is for INFORMATIONAL PURPOSES ONLY. We are not responsible for:
- Financial decisions made based on App data
- Errors in transaction parsing or calculations
- Discrepancies between App data and official MPESA records
8. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, or consequential damages
- Loss of profits, revenue, or data
- Business interruption
- Any damages arising from use or inability to use the App
Our total liability to you for any claim shall not exceed the amount you paid to use the App in the 12 months preceding the claim (which may be zero if the App is free).
9. THIRD-PARTY SERVICES
9.1 MPESA
We are NOT affiliated with, endorsed by, or connected to Safaricom's MPESA service. MPESA is a registered trademark of Safaricom PLC.
9.2 Supabase
We use Supabase for cloud storage and authentication. Your use is subject to Supabase's terms and policies.
9.3 No Liability
We are not responsible for:
- MPESA service availability or accuracy
- Changes to MPESA message formats
- Third-party service interruptions
10. DATA RETENTION AND DELETION
10.1 Retention
We retain your data for as long as your account is active or as needed to provide services.
10.2 Account Deletion
You may request account deletion at any time. Upon deletion request, we will remove your personal data within 30 days, except as required by law.
11. MODIFICATIONS TO TERMS
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App.
We will notify you of material changes via in-app notification or email. Your continued use of the App after changes constitutes acceptance of the updated Terms.
12. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to conflict of law principles.
